Terms of Service

Welcome to Chorus Research. These Terms of Service ("Terms") govern your access to and use of the Chorus Research platform, including any content, functionality, and services offered through our website and application (collectively, the "Service").

Chorus Research is operated by Collective Measure, Inc., a Delaware corporation ("Company," "we," "us," or "our").

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service

Chorus Research is an end-to-end research and survey platform that enables users to create surveys, distribute them to respondents, collect responses, and analyze results. Our Service is designed for researchers, businesses, and individuals who need to gather and analyze survey data.

2. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Collect personal information without proper consent
  • Distribute malware or other harmful code
  • Engage in spam, phishing, or other deceptive practices
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service

4. Customer Content

You retain all ownership rights in the content you create, upload, or collect through the Service ("Customer Content"), including survey designs, questions, and response data.

By using the Service, you grant us a limited, non-exclusive license to host, store, process, and display your Customer Content solely for the purpose of providing the Service to you. This license ends when you delete your Customer Content or close your account.

You are solely responsible for ensuring that your Customer Content complies with applicable laws and does not infringe on any third-party rights.

5. Billing and Payment

Chorus Research operates on a pay-per-survey model. When you launch a survey, you specify the number of respondents you want to reach, review the price, and pay upfront before the survey begins collecting responses.

  • All payments are processed in US dollars
  • Payment is required at the time of survey launch
  • You may stop an active survey at any time, but stopping a survey does not result in an automatic refund
  • Prices are subject to change with reasonable notice
  • You are responsible for any applicable taxes

6. Refunds

Refund requests are handled on a case-by-case basis. Please see our Refund & Dispute Policy for more information.

7. Intellectual Property

The Service, including all software, design, text, graphics, and other content (excluding Customer Content), is owned by Collective Measure, Inc. and is protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business or personal purposes.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLECTIVE MEASURE, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Collective Measure, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

You may terminate your account at any time by following the cancellation process in your account settings or by contacting support. We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

14. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website. Your continued use of the Service after such notification constitutes your acceptance of the modified Terms.
